These Terms of Use (“Terms”) govern your use of the Drag Race & 0-60 Performance Timer mobile application. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for your personal, non-commercial use, subject to these Terms and the rules of the app store from which you obtained the App.

You may not copy, modify, reverse engineer, decompile, redistribute, or create derivative works from the App, except to the extent permitted by applicable law.

2. The App and how it works

The App uses GPS (and, on some devices, sensor data such as the accelerometer and barometer) to estimate speed, acceleration, distance, split times, G-force, and route information for vehicle performance testing.

These readings are estimates only and may be inaccurate due to factors such as GPS signal quality, tunnels, buildings, weather, hardware limitations, sensor calibration, and satellite availability. The App is intended for informational and entertainment purposes and must not be relied upon where accuracy is critical.

3. Safety — important

Performance testing involves acceleration and speed and can be dangerous.

Only use the App where it is legal and safe to do so — for example, a closed course, a private track, or a controlled environment. Do not use it to encourage or measure speeding or any illegal driving on public roads.
Do not operate, hold, or interact with your device while driving. Set up the App before you start, and have a passenger handle it where possible.
You are solely responsible for complying with all traffic laws, speed limits, and local regulations, and for driving safely.
You assume all risk arising from your use of the App and from any driving or vehicle activity you perform.

4. Subscriptions and purchases

The App offers some features for free and offers premium features through a paid subscription.

Subscriptions may be automatically renewing, non-renewing (where available), or one-time purchases, as presented in the App.
Payments are processed by the store you obtained the App from — the Apple App Store or Google Play — and are charged to that account at confirmation of purchase. Our subscription provider, RevenueCat, is used to verify entitlements; it does not process your payment.
Where offered, a free trial may be available; unless cancelled before the trial ends, it converts into a paid subscription. Any unused portion of a free trial is forfeited when a subscription is purchased.
Auto-renewing subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period, and the renewal is charged within 24 hours of the end of that period. You can manage or cancel your subscription at any time:
- iPhone and iPad: Settings → tap your name → Subscriptions.
- Android: Google Play Store → your profile → Payments and subscriptions → Subscriptions.
Deleting the App does not cancel a subscription. It must be cancelled in your store account settings as described above.
Prices may vary by region and may change; any change will apply in accordance with the app store's rules.

5. Acceptable use

You agree not to:

Use the App for any unlawful purpose or in violation of any applicable law;
Use the App in a way that endangers yourself or others;
Interfere with or disrupt the App or the services it relies on.

6. Disclaimer of warranties

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that measurements will be accurate.

7. Limitation of liability

To the maximum extent permitted by law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of (or inability to use) the App, including any vehicle damage, injury, fines, or losses resulting from driving activity. Where liability cannot be excluded, it is limited to the amount you paid for the App in the 12 months preceding the claim.

8. Changes to the App and Terms

We may modify or discontinue the App (or any feature) at any time. We may also update these Terms; the “Last updated” date reflects the latest version. Continued use of the App after changes become effective constitutes acceptance of the updated Terms.

9. Governing law

These Terms are governed by the laws of Portugal, without regard to its conflict-of-law rules, unless mandatory consumer-protection laws of your country of residence apply.
